Terms of Use

Welcome to The MathsGenius (“we”, “us”, “our”). These Terms of Use (“Terms”) govern your access to and use of themathsgenius.com and our mobile apps on iOS and Android (the “Service”). By using the Service, you agree to these Terms.

1. Who we are & Contact

The MathsGenius helps learners master mathematics aligned to British, Nigerian and international curricula. Contact us at hello@themathsgenius.com.

2. Eligibility & Accounts

• You must be at least 13 years old, or use the Service under the consent and supervision of a parent/guardian or school.
• You’re responsible for safeguarding your login details and all activity under your account.
• You agree to provide accurate information and keep it up to date.

3. Subscriptions, Billing & Refunds

• Some features require a paid plan (e.g., premium challenges, exam prep, advanced analytics).
• Payments are processed by third-party providers (e.g., card processors, app stores). Local taxes may apply.
• Plans auto-renew until you cancel. Manage cancellation in your account settings or via the app store used for purchase.
• Refunds follow the rules of the platform used for purchase (web checkout or app store). Where permitted by applicable law, contact support for help at hello@themathsgenius.com.
• We may change prices prospectively; we’ll notify you in advance as required by law.

4. Free Trials & Promotions

• Trial eligibility and duration may vary. When a trial ends, your plan converts to a paid subscription unless you cancel beforehand.
• Promotions can’t always be combined unless explicitly stated.

5. Educational Integrity

The Service supports learning and revision. You agree not to use it to cheat or to misrepresent your work in any assessment or exam.

6. Licence & Intellectual Property

• We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for non-commercial learning.
• All Service content (lessons, questions, media, UI, software) is owned by us or our licensors and is protected by law.
• You may not copy, distribute, adapt, reverse engineer, or create derivative works except as permitted by law or with our written consent.

7. User Content

• You retain rights to content you submit (e.g., messages, profile info). You grant us a worldwide, non-exclusive licence to host, process, and display that content to operate and improve the Service.
• You will not upload unlawful, harmful, infringing, or abusive content, or content you lack rights to share.

8. Acceptable Use

• No unlawful activities, harassment, discrimination, or exploitation.
• No attempts to bypass security, probe systems, or disrupt the Service.
• No automated scraping or rate-limiting circumvention without written permission.

9. Mobile Apps & App Stores

When using our iOS/Android apps, you must comply with Apple App Store and Google Play terms. App-store purchases, billing and refunds are governed by those stores.

10. Third-Party Links & Services

The Service may link to or depend on third-party sites, SDKs or tools (e.g., video hosting, analytics, payments). We do not control and are not responsible for their content, policies, or practices.

11. Privacy

Your privacy matters. Our Privacy Policy explains what data we collect, how we use it, and your rights. By using the Service, you also agree to our Privacy Policy.

12. Disclaimers

The Service is provided “as is” and “as available” to the fullest extent permitted by law. We don’t guarantee specific results, uninterrupted availability, or that content will be error-free. Where disclaimers are restricted by local law, they apply to the maximum extent allowed.

13. Limitation of Liability

To the fullest extent permitted by law, we won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues, data, or goodwill arising from or related to your use of the Service. Where such limitations are restricted by local law, they apply to the maximum extent allowed.

14. Indemnity

You agree to defend, indemnify, and hold us harmless from claims or demands (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms, to the extent permitted by law.

15. Suspension & Termination

• We may suspend or terminate your access if you violate these Terms or if required by law or security concerns.
• You may stop using the Service at any time. If you cancel a paid plan, you retain access until the end of the current billing period unless otherwise stated.

16. Changes to the Service

We may modify, suspend, or discontinue features or the Service where reasonable (e.g., to improve performance, comply with law, or address security). For material changes that significantly affect paid features, we’ll provide notice where required.

17. Changes to these Terms

We may update these Terms from time to time. We will post changes here and update the “Effective date”. If changes are material and affect your paid subscription, we’ll notify you where required by law.

18. Governing Law & Dispute Resolution (International)

These Terms and any disputes or claims (contractual or non-contractual) arising out of or in connection with them or their subject matter are governed by the laws of England and Wales, without regard to conflict-of-law principles,unless the mandatory consumer protection laws of your country of residence require otherwise—in which case those laws apply.

You and we agree that the courts of England and Wales shall have jurisdiction,or if you are a consumer resident in the UK or EEA, you may also bring proceedings in your local courts. Nothing in this clause limits any non-waivable rights you have under applicable law.

Note: If you prefer to use arbitration for certain regions (e.g., USA), add an arbitration section and opt-out instructions here to meet local requirements.

19. Miscellaneous

• Entire Agreement: These Terms (plus any referenced policies) are the entire agreement between you and us regarding the Service.
• Severability: If any part of these Terms is found unenforceable, the remaining parts remain in effect.
• No Waiver: Our failure to enforce a provision isn’t a waiver of our rights.
• Assignment: You may not assign these Terms without our consent. We may assign to an affiliate or in connection with a merger or sale.
• Force Majeure: We aren’t liable for delays or failures due to events beyond our reasonable control.
